Legal regulations:
- Act No. 329/2011 Coll., on the provision of benefits to persons with disabilities (hereinafter the "Act on the provision of benefits to persons with disabilities")
- Decree No. 388/2011 Coll., implementing certain provisions of the Act on the provision of benefits to persons with disabilities (hereinafter the "Decree")
The Act on the provision of benefits to persons with disabilities regulates:
- disability cards
- the mobility allowance
- the special aid allowance
Decision-making authority:
- regional branches of the Labour Office of the Czech Republic (hereinafter "regional branches of the Labour Office")
- Ministry of Labour and Social Affairs — appellate body
Disability Card
- The disability card replaces the special benefits card that certified the degree of the discontinued "special benefits" system. The existing paper TP, ZTP, and ZTP/P cards are being replaced by disability cards, which retain these established abbreviations.
- Although the "special benefits" system is ending, the benefits that persons with disabilities derived from holding TP, ZTP, and ZTP/P cards remain in effect.
- The Act allows two methods of issuing a disability card: automatically in connection with the granting of a care allowance or mobility allowance, and independently upon application.
- The disability card is not a standalone document but is part of the social systems card. One of the card's functions is that of a disability card.
TP Card is issued to those whom the Social Services Act considers dependent on the help of another person at degree I (mild dependency). If they are unable to manage the basic life needs of mobility or orientation, they are entitled to a ZTP/P card.
ZTP Card is issued to those whom the Act considers dependent on the help of another person at degree II (moderate dependency). If someone at dependency degree II is unable to manage the basic life needs of mobility or orientation, they are entitled to a ZTP/P card.
ZTP/P Card is issued to persons dependent on help at degree III (severe dependency) or degree IV (complete dependency), and to those who have been found unable to manage the basic life needs of mobility or orientation.
Inability to manage the basic life needs of mobility or orientation means (with the exception of adults with total or practical deafness) a ZTP/P card regardless of the degree of dependency.
Those who do not wish to receive a care allowance or mobility allowance but want to hold a disability card may apply for one at the regional branch of the Labour Office.
A TP card holder is entitled to:
- a reserved seat on public transport vehicles for regular mass transit, except for vehicles where seating is subject to the purchase of a reservation
- priority in dealing with matters that require longer waiting, particularly standing; dealing with matters does not include shopping in stores, obtaining paid services, or treatment and examination at healthcare facilities
A ZTP card holder is entitled to:
- a reserved seat on public transport vehicles for regular mass transit, except for vehicles where seating is subject to the purchase of a reservation
- priority in dealing with matters that require longer waiting, particularly standing; dealing with matters does not include shopping in stores, obtaining paid services, or treatment and examination at healthcare facilities
- free travel on regular local public transport services — trams, trolleybuses, buses, and the metro
- a 75% discount on second-class fares on domestic passenger trains and express trains, and a 75% discount on regular domestic bus services
A ZTP/P card holder is entitled to:
- a reserved seat on public transport vehicles for regular mass transit, except for vehicles where seating is subject to the purchase of a reservation
- priority in dealing with matters that require longer waiting, particularly standing; dealing with matters does not include shopping in stores, obtaining paid services, or treatment and examination at healthcare facilities
- free travel on regular local public transport services — trams, trolleybuses, buses, and the metro
- a 75% discount on second-class fares on domestic passenger trains and express trains, and a 75% discount on regular domestic bus services
- free travel for a companion on public mass transport in regular domestic services
- free travel for a guide dog for the blind
Holders of ZTP or ZTP/P cards, and the companion of a ZTP/P card holder, may be offered discounted admission to theatre and film performances, concerts, and other cultural and sporting events. These benefits are non-statutory. Further entitlements of TP, ZTP, or ZTP/P card holders are governed by other legal regulations, such as the Income Tax Act, the Local Fees Act, the Administrative Fees Act, the Road Traffic Act, and the Property Tax Act.
Special benefits cards (paper TP, ZTP, and ZTP/P cards) issued under regulations effective until the end of 2011 remain valid after that date until the expiry of the validity period indicated on those cards, but no later than 31 December 2015.
